Referral Programme Terms

About these terms

These terms apply to the subba referral programme, run by Polarize Ltd, registered in England and Wales (company number 12944077), registered office 20-22 Wenlock Road, London, N1 7GU, trading as subba (“we”, “us”).

You agree to these terms when you share your referral link, request a payout, or accept them in your subba account. If you do not agree, please do not take part.

If you also use subba for your business, our Terms of Service cover that use. Where the two differ on the referral programme, these terms apply.

Who can take part

Anyone aged 18 or over with a subba account, and people we invite as referral partners with a referral-only account.

To be paid you need a UK bank account. We pay through Stripe, so you may need to complete Stripe’s identity checks.

We may refuse anyone a place in the programme, or end it, at our discretion.

Your referral link

Your link looks like subba.pro/?ref=yourcode. You can change your code in your account, and your old link stops working when you do.

A referral counts when a business signs up to a brand-new subba account through your link and starts paying for a subba plan.

We record the referral from your link and, if the visitor accepts marketing cookies, a cookie that lasts 90 days, so they can come back and sign up later. Without that cookie, they need to sign up during the same visit. If a visitor used more than one referral link, the one we recorded first counts.

These do not count: businesses already using subba; extra businesses added to an existing subba login; accounts you open for yourself or for a business you own or run; and accounts opened in someone else’s name without their knowledge.

Our records decide whether a referral counts. If you think one is missing or wrong, tell us within 60 days of the sign-up and we will look into it.

What you earn

Every month, 10% of the profit we make on each referred business’s subscription: what they paid for their subba plan that month, less card and payment fees, the cost of running their AI receptionist, and domain costs if we host their website. Add-ons, such as text reminders and the phone line, are not included. Commission for one business in one month is never more than 40% of what they paid for their plan that month.

When we build a website for a referred business, 50% of the website fee they pay us: £100 on our standard £200 build.

You earn for every month the business pays for a plan, with no end date. Nothing is earned during free trials, on free plans or for months that are not paid.

We may agree different rates with you in writing. Those rates then apply to you instead of the ones above.

We work out commission each month for the previous calendar month, in pounds sterling. Commission includes VAT, if any applies, and you are responsible for any tax on what you earn.

When commission can be paid

Commission for a month becomes payable 30 days after the end of that month, and only once the referred business has been with subba for 3 months (90 days from its sign-up).

If a referred business gets a refund, or disputes or reverses a payment, its commission that has not yet been paid out is cancelled. If we have paid commission that turns out not to be due, we may take it off future commission or ask you to pay it back.

If a referred business stops paying or closes its account, commission for it stops.

Payouts

You can ask for a payout of your payable balance from your account at any time. There is no minimum.

We check each request and aim to pay within 14 days, through Stripe to the bank account you connect, or by bank transfer.

We may hold a payout while we look into suspected fraud or a breach of these terms.

How you may promote subba

Describe subba honestly. Do not make claims about its prices, results or features that we do not make ourselves.

Do not send spam or unsolicited marketing, and follow the law on marketing and data protection, including the UK GDPR and the Privacy and Electronic Communications Regulations.

Do not bid on search adverts for “subba” or similar terms, and do not create websites, social media accounts or apps that could be mistaken for ours.

Do not offer cash, gifts or other rewards to people for signing up, unless we agree to it in writing.

Do not use fake accounts, cookie stuffing or any other trick to earn commission you have not genuinely earned.

You may use our name and logo only to refer people to subba, in the form we provide them, and you must stop if we ask. You are not our agent or employee and must not present yourself as acting for us.

Personal data

We do not share referred businesses’ personal data with you. You see that a referral joined and the commission owed.

We use your details, including payout details held by Stripe, to run the programme and pay you, as our Privacy Policy explains.

Changes and ending

We may change these terms, the commission rates or the programme, or end it. We will give you at least 30 days’ notice, by email or in your account, before a change that reduces what you can earn. Commission earned before a change is paid under the terms that applied when it was earned.

You can stop taking part at any time by telling us. Commission that was already payable when you stopped is still yours to request.

If you break these terms, we may suspend or end your part in the programme and cancel any commission connected with the breach.

Liability

We do not promise any number of referrals or level of earnings. Examples and calculators on our website are estimates only.

Our total liability to you under these terms is limited to the commission payable to you in the 12 months before your claim. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

General

These terms do not create a partnership, joint venture, agency or employment relationship between you and us.

These terms are governed by the laws of England and Wales, whose courts have exclusive jurisdiction.
